When no expert review of project documentation is required

Examination of design documentation and results of engineering searches, state environmental examination of design documentation of objects, construction, reconstruction of which is expected to be carried out in the exclusive economic zone of Ukraine, in internal sea waters, on the lands of specially protected natural territories.


1. Design documentation of capital construction objects and the results of engineering searches performed for the preparation of such design documentation are subject to examination, except for the cases provided for in parts 2, 3 and 3.1 of this article. Examination of project documentation and (or) examination of the results of engineering studies are carried out in the form of state examination or non-state examination. The developer or the technical customer, at his choice, sends the project documentation and the results of engineering investigations to the state examination or non-state examination, except in cases where, in accordance with this article, regarding the design documentation of capital construction objects and the results of engineering investigations carried out for the preparation of such design documentation, a state examination is provided.

2. Expertise is not carried out regarding the project documentation of the following capital construction objects:

  1. separate residential buildings with the number of floors not exceeding three, intended for the residence of one family (objects of individual residential construction);
  2. residential buildings with the number of floors no more than three, consisting of several blocks, the number of which does not exceed ten and each of which is intended for the residence of one family, has a common wall (common walls) without openings with the neighboring block or neighboring blocks, located on a separate plot of land and has access to the territory of public use (residential buildings of blocked buildings);
  3. multi-apartment buildings with the number of floors not exceeding three, consisting of one or more block sections, the number of which does not exceed four, in each of which there are several apartments and common rooms and each of which has a separate
  4. entrance with access to the territory of the common use;
    separate objects of capital construction with the number of floors no more than two, the total area of which is no more than 1,500 square meters and which are not intended for the residence of citizens and the implementation of industrial activities, with the exception of objects that, in accordance with Article 48.1 of this Code, are particularly dangerous, technically complex or unique objects;
  5. separate objects of capital construction with the number of floors no more than two, the total area of which is no more than 1,500 square meters, which are intended for the implementation of production activities and for which the establishment of sanitary and protective zones is not required or for which within the boundaries of land plots, on which such objects are located, sanitary protection zones are established or such zones are required, with the exception of objects that, in accordance with Article 48.1 of this Code, are particularly dangerous, technically complex or unique objects.

3. Examination of project documentation shall not be conducted if construction or reconstruction does not require obtaining a construction permit, as well as in the case of such an examination of the project documentation of capital construction objects, which received a positive conclusion from a state examination or non-state examination and is reapplied (hereinafter - typical design documentation), or modifications of such design documentation that do not relate to structural and other reliability and safety characteristics of capital construction objects, or in the event that during the construction or reconstruction of linear objects, a modification of the examination of design documentation is applied, which received a positive conclusion (including individual sections). design documentation), which does not reduce the structural and other reliability and safety characteristics of linear objects and does not change their qualitative and functional characteristics, provided that the indicated modification of the design documentation does not lead to an increase in the estimate for the construction and reconstruction of linear objects. Examination of project documentation is not carried out in relation to sections of project documentation prepared for the capital repair of capital construction objects, except for project documentation prepared for the capital repair of public highways.

3.1. The examination of the results of engineering studies is not carried out if the engineering studies were carried out for the preparation of project documentation of the capital construction objects specified in part 2 of this article, as well as if obtaining a construction permit is not required for construction or reconstruction.
